Indirectement, oui, parce que flicker a des limites sur le nombres de 
photos (Robin pourra confirmer, je n'utilise pas flicker).

Voir remarque précédante. C'est commode pour les individus, mais rien 
n'oblige FACIL à accepter le contrat d'utilisation de flickr, qui est 
maintenant celui de yahoo:

J'ai fait une lecture rapide du contrat d'utilisation de yahoo. Voici 
les points innaceptable: 

* ...which may be updated by us from time to time without notice to you.

* ...you and Yahoo! shall be subject to any posted guidelines or rules 
applicable to such services, which may be posted from time to time.

[you shall not...]
* g. upload, post, email, transmit or otherwise make available any 
unsolicited or unauthorized advertising, promotional materials, "junk 
mail," "spam," "chain letters," "pyramid schemes," or any other form of 
solicitation, except in those areas (such as shopping) that are 
designated for such purpose (please read our complete Spam Policy);

De manière intéressante, cette clause est violée par tout utilisateur du 
service de couriel qui ajoutes des publicitées non-solicités au bas de 
chaque message....

* l. provide material support or resources (or to conceal or disguise 
the nature, location, source, or ownership of material support or 
resources) to any organization(s) designated by the United States 
government as a foreign terrorist organization pursuant to section 219 
of the Immigration and Nationality Act;

* You acknowledge that Yahoo! may or may not pre-screen Content, but 
that Yahoo! and its designees shall have the right (but not the 
obligation) in their sole discretion to pre-screen, refuse, or move any

Cette clause nous oblige à créer notre propre archive si ont veut 
s'assurer de la périnitée de nos données.

rules set by Yahoo! and/or content providers who provide content to the 
Service. You may not attempt to override or circumvent any of the usage

Cette dernière clause nous forcerait à entériner l'usage de mesures 
technologiques de protection du droit d'auteur, ce a quoi FACIL est 
opposé (au moins dans la mesure où elles ne sont pas partie de 
standards ouverts), et, pire encore, à entériner l'idée de régles 
contre le contournement de telles mesures. Cette clause est 
complètement innaceptable.  

Maintenant, concernant les droits sur les photos:

Bref, nous donnons à yahoo le droit de réutiliser nos photos sous une 
licence que nous n'avons pas choisit. 

Enfin:

Les logiciels utilisés et distribués par yahoo sont des logiciels 
propriétaires. Pourquoi FACIL devrait-il utiliser un tel service?

L'informatique libre est aussi un pool d'intelligne collective partagée, 
beaucoup plus important que cette banque de photo, et la mission de 
FACIL est d'en faire la promotion. Il serait inconsistant pour nous 
d'accepter un contrat avec plusieurs clauses qui vont dans le sens 
contraire de ce que FACIL doit promouvoir, simplement parce que flickr 
est cool ou utile. 

Tes arguments au sujets de l'utilité de la mise en commun des données et 
de la recherche de la facilité d'accès sont cependant valables, et 
méritent sans doute la création d'un nouveau site communautaire (avec 
l'aide d'un groupe intéressé) ou au moins la modification de notre 
propre site.

Maintenant, remplacer des services fermées en allant contre nos 
principes par des services ouverts me ferait le plus grand bien, ainsi 
qu'à beaucoup d'autres personnes. Je ne comprends pas comment tu peux 
penser que c'est NOUS qui voulons centraliser en créant notre petit 
site pour les besoins de FACIL, alors que flickr est devenu si 
centralisateur que yahoo à jugé bon de l'acheter.
